Packaged Retail and Insurance-based Investment Products (PRIIPs)
The Packaged Retail and Insurance-based Investment Products (PRIIPS) Regulation requires that a KID be prepared in respect of any offer of a PRIIP to retail investors in the European Economic Area (“EEA”), which must be made available in good time prior to an investment decision being made by such retail investor.
The PRIIPs Regulation becomes effective as of 1 January 2018.
The PRIIPs Regulation requires that a KID be prepared in respect of any offer of a PRIIP to retail investors in the EEA. Unless notified by you in advance, and then agreed with you that a KID is necessary in relation to an offer of a Barclays PRIIP, we will not prepare a KID. Should you require a KID please contact your usual Barclays business representative.
Unless notified by you in advance and then agreed with you, that a KID has been drawn up by, or on behalf of, a third party issuer in relation to a Third Party PRIIP, you should not assume a KID has been or will be published or provided to you.
You acknowledge that neither Barclays PRIIPs nor Third Party PRIIPs sold to you by Barclays can be made available to retail investors (as determined in accordance with MiFID II) in the EEA without a KID and that it is your responsibility, as distributor, to ensure that the KID is made available to EEA retail investors in good time prior to an investment decision being made by such retail investor.
Barclays shall have no liability to you or to your EEA retail client for distribution of such PRIIP without a KID (regardless of whether a KID has been published by the PRIIP manufacturer).
Barclays PRIIPs issued prior to 1 January 2018 for which no KID has been produced will not be available for sale to any retail investor by Barclays from and including 1 January 2018.
